Agreement to These Terms

By visiting our website, submitting a repair request, or using our services, you agree to these Terms of Service. Please read them carefully. If you do not agree, do not use our website or services. These terms apply to all customers in the United States and Canada.

These Terms of Service are entered into by you and iMobile Denver ("we," "us," or "our"), located at 1272 S Sheridan Blvd, Denver, CO 80232.

Our Services

iMobile Denver provides device repair services, device purchasing, device resale, and related services. Specific services available at each location may vary. We reserve the right to decline any repair or service request at our discretion.

Repair Services

Estimates and pricing

Repair quotes provided online, by phone, or through our form are estimates only. Final pricing is determined after in-person inspection of the device. We will not begin any repair without your approval of the final price. If additional issues are discovered during repair, we will contact you before proceeding.

Diagnostic services

A diagnostic fee may apply for inspection of devices where no repair is performed. This fee will be disclosed before any diagnostic work begins. Where repair is completed, diagnostic fees may be waived or applied toward the repair cost.

Turnaround time

Estimated repair times are provided in good faith but are not guaranteed. Repair time may vary based on device model, part availability, repair complexity, and shop volume. We will notify you of any significant delays.

Device pickup

Devices must be picked up within [X] days of repair completion. We will make reasonable attempts to contact you. After [X] days, we reserve the right to charge a storage fee. Devices not claimed after [X] days may be considered abandoned and may be disposed of or donated in accordance with applicable law.

Data and personal information on devices

We are not responsible for loss of data on any device brought in for repair. You are responsible for backing up your data before leaving your device with us. By leaving a device, you confirm that you have backed up your data or accept the risk of data loss. Our technicians will handle your device with care, but repair procedures may result in data loss in some circumstances.

Proof of ownership

By leaving a device for repair, you represent that you are the legal owner of the device or are authorized by the owner to have it repaired. We reserve the right to refuse service on devices that appear to be lost or stolen. We may require proof of ownership or identity before accepting certain devices.

Warranty on Repairs

We stand behind our repair work. Our warranty covers defects in parts and workmanship from the completed repair for 30 days from the date of service, unless otherwise specified at time of repair.

The warranty does not cover:

• Physical damage, drops, or impacts occurring after repair
• Liquid or moisture damage occurring after repair
• Software issues, viruses, or unauthorized modifications
• Damage caused by misuse, neglect, or accidents
• Damage to components unrelated to the original repair
• Normal wear and tear

To make a warranty claim, return to any iMobile Denver location with proof of repair and your device. We will inspect the device and determine whether the issue is covered under warranty. Warranty service is provided at no charge for covered repairs. Warranty claims do not extend the original warranty period.

Device Purchasing and Trade-In

If you sell or trade in a device to us, you represent that you are the legal owner of the device, the device is not stolen or subject to any lien or encumbrance, and you have the right to sell or transfer it. We may verify device status before completing a purchase. We reserve the right to decline purchase of any device. All sales to us are final. Prices offered are based on our assessment of the device condition at time of purchase and are subject to change after inspection.

Refurbished Device Sales

Refurbished devices we sell are inspected, tested, and cleaned before sale. Each device is sold with a 90-day warranty covering hardware defects unless otherwise stated. Devices are sold "as-is" beyond the stated warranty. We are not affiliated with original manufacturers, and refurbished devices are not covered by original manufacturer warranties.

Website Use

You may use our website for lawful purposes only. You agree not to use our website to transmit harmful, offensive, or illegal content; attempt to gain unauthorized access to our systems; interfere with the operation of our website; or collect information about other users without authorization.

We reserve the right to refuse service, terminate access, or cancel transactions at our discretion. We may update, modify, or discontinue any part of our website without notice.

SMS and Text Message Terms

By providing your mobile phone number and submitting a form on our website, you consent to receive text messages from iMobile Denver. By opting in to our SMS program, you agree to the following:

• Program description: iMobile Denver sends text messages for repair updates, appointment reminders, quotes, and where separately consented, marketing messages about our services and promotions.
• Message frequency: Transactional messages are sent as needed for your repair or service request. Marketing messages, where consented, are sent up to [X] times per month.
• Message and data rates: Standard message and data rates from your mobile carrier may apply to all messages sent and received.
• How to opt out: Reply STOP to any message to unsubscribe from that message type. Reply HELP for assistance. You may also contact us directly at (720) 224-5403 or Imobiledenver@gmail.com to manage your preferences. Opting out of marketing messages does not affect messages related to an active repair or service.
• Consent is not required: Agreeing to receive marketing text messages is not a condition of purchasing any goods or services from us.
• Supported carriers: Carriers are not liable for undelivered messages. Message delivery is not guaranteed on all networks.

For customers in Canada: Our SMS communications are governed by Canada's Anti-Spam Legislation (CASL). You have the right to withdraw consent for commercial electronic messages at any time by replying STOP or contacting us directly.

Payments

Payment is due upon completion of service unless other arrangements have been made in advance. We accept [payment methods — update at onboarding]. For purchases and trade-ins, payment terms are confirmed at time of transaction. All prices are in USD unless otherwise specified.

Limitation of Liability

To the maximum extent permitted by applicable law, iMobile Denver and its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or website, including but not limited to loss of data, loss of profits, or damages arising from device repair. Our total liability for any claim arising from our services shall not exceed the amount you paid for the specific service giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

Indemnification

You agree to indemnify and hold harmless iMobile Denver and its owners, employees, and agents from any claims, losses, damages, or expenses (including reasonable legal fees) arising from your violation of these Terms, your use of our services, or your misrepresentation of ownership or authority over a device.

Governing Law and Disputes

For US customers: These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles. Any dispute arising from these Terms or our services shall be resolved in the courts of Denver County, Colorado.

For Canadian customers: These Terms are governed by the laws of the Province of [Province] and the federal laws of Canada applicable therein. Any dispute shall be resolved in the courts of [Province].

Before initiating any legal action, you agree to contact us in writing and allow us 30 days to attempt to resolve the dispute informally.

Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the date at the top of this page. Your continued use of our website or services after changes are posted constitutes your acceptance of the updated Terms.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
